Property sale: You really need these documents

Energy certificate, land register extracts, building plans - anyone who wants to sell their property quickly encounters bureaucratic hurdles. To ensure that the sale goes smoothly, we have compiled the most important documents and their sources for you.

1. extract from the land register

The extract from the land register is essential to prove who the owner is and whether there are any encumbrances such as debts or mortgages. From where? You can obtain it from the Land registry.

2. parcel map

The cadastral map officially confirms the existence of the property. It shows:

  • Location and boundaries
  • Development
  • Parcel and plot number

From where? Responsible is the Cadastral office.

3. construction plans and building permits

The construction plans include

  • Building permit certificate
  • Building description
  • Acceptance certificate (for newer buildings)

From where? You can obtain these documents from Building authority.

4. calculation of living and usable space

Prospective buyers often ask for the exact living and usable space. Occasionally they also want to know the Volume of the property (enclosed space - UR, gross cubic capacity - BRI). From where? You can obtain this information from the Building authority or from your architect.

5. extract from the register of building encumbrances

Public-law obligations of the property owner are entered here, such as

  • Specifications for clearance areas
  • Locations for waste bins

From where? Responsible is the Building authority.

6. energy certificate

A Energy certificate is mandatory. Without it, you could face fines of up to 15,000 euros. From where? A qualified energy consultant, architect or engineer issues it.

7. maintenance and modernisation measures

Prepare an overview of Maintenance and modernisation measures of the last two years. These include:

  • Refurbishments and repairs
  • Operating costs such as taxes and insurance

8. additional documents for apartment blocks and condominiums

For owner-occupied flats and apartment blocks, you also need

  • Declaration of division
  • Minutes of the last owners' meetings
  • Rental or lease agreements
  • Proof of residential and usage rights

From where? You can obtain these documents from Land registry, the Property management or the WEG administrator.
