📞 Carefree home ownership: tips for a smooth move

The dream of owning your own home is coming true - you are about to move out of your rented flat. To ensure that the transition goes smoothly and no unexpected problems arise, you should bear a few important points in mind.

Subsequent tenant: No automatic right

Many tenants hope to be released from their tenancy agreement more quickly by finding a new tenant. But be careful: without a corresponding clause in the tenancy agreement, the landlord is not obliged to accept a new tenant. However, there is an exception in special cases, such as a job-related move or relocation to a care home. However, the desire to move into a new home is not legally sufficient to terminate the tenancy agreement prematurely.

Renovation: check rights and obligations

The question of the obligation to renovate often causes conflicts. In principle, the landlord is responsible for maintenance work. However, so-called cosmetic repairs are often transferred to the tenant in the tenancy agreement. However, these clauses are only valid if they set out clear guidelines and do not stipulate rigid deadlines. It is worth having the tenancy agreement checked by a lawyer to avoid potential disputes.

Rent deposit: patience required

The repayment of the rental deposit is another sticking point. Landlords have the right to check claims for up to six months after moving out before paying out the deposit. This is often related to the utility bills, which are often not available until the middle of the year. Rapid repayment is therefore the exception rather than the rule.

Handover: order is a must

On the day of the move, you should ensure that the flat is completely empty. Permanently installed fixtures such as shower enclosures or fitted kitchens must also be taken away or disposed of, unless the landlord agrees to the new tenant taking them over. A friendly agreement can often go a long way here.
